The offers on our website "https://pompeiluxury.com/" are intended exclusively for consumers who conclude the purchase for a purpose that can be attributed neither to a commercial nor professional activity. 1. Conclusion of the contract and delivery of products 1.1 By placing an order, you declare that you are acting solely for private purposes. 1.2 Every order placed on "https://pompeiluxury.com/" implies the conclusion of a contract of sale in the Italian language. When the order relates to a Product of "Pompei Luxury", only one contract is concluded between the buyer and "Pompei Luxury". 1.3 By clicking on the "Buy Now" button, the customer places a binding order with respect to the items contained in the virtual shopping cart. Once the order has been transmitted, "Pompei Luxury" will send an order confirmation e-mail to the customer within 1 hour. A contract shall be deemed to be concluded in a binding manner upon receipt of an order confirmation from us. If the customer does not receive any order confirmation within the period specified in this Article 1.2, the relevant order shall be deemed to have been rejected by "Pompei Luxury" and, therefore, to be of no effect. "Pompei Luxury" is only obliged to deliver what is in stock and what it has ordered from its suppliers. "Pompei Luxury" makes deliveries in the Italian territory only. If the delivery time is expressed in working days, this shall be understood as all those between Monday and Friday inclusive, with the express exclusion of any public holidays. 1.7 We reserve the right not to accept or to cancel an order where it has been sent by using software, robots, crawlers, spiders or any automated system or by script-based behavior and any use of third-party services in order to send an order on your behalf. 2. Prices, shipping charges and express delivery 2.1 The customer is obliged to pay the price published on the product page when placing the order. The stated price is final and includes VAT. 2.2 Shipping costs amount to (for Italy) 6,90ā¬, for the rest of the countries that are part of SEPA the shipping costs amount to 16,00ā¬ (VAT included) These shipping costs are invoiced by "Pompei Luxury". In the event that the Customer returns the products in accordance with the procedure set forth in these conditions and applicable regulations, the shipping costs will be refunded. 2.3 Express delivery is available only for certain products. When placing the order, the Customer will display, if available, the option to opt for express delivery and the additional costs involved. This option provides for delivery of the goods within a maximum of 5 (five) business days. If delivery does not occur within this period, the customer will be reimbursed for the shipping costs incurred. 3. Payment 3.1"Pompei Luxury" accepts several methods of payment including, for illustrative purposes:, by credit card, by bank transfer , Paypal and cash on delivery. "Pompei Luxury" reserves the right to refuse certain payment methods and to require different payment methods for certain orders. Please note that "Pompei Luxury" only accepts payments from bank accounts within the European Union (EU) and that the customer is responsible for any costs associated with the transaction. 3.2 In the case of a purchase made by credit card, the charge is made when the order is shipped. 3.3 The buyer agrees to receive invoices and credits in electronic format only. 6. Right of withdrawal for: "Pompei Luxury" Products. However, the right of withdrawal is subject to the following conditions: - the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product; - the purchased goods must be undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; should be avoided in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product; Without prejudice to any repair costs for damages assessed to the original packaging, "https://pompeiluxury.com/" will refund the customer the full amount already paid, net of shipping costs incurred, within 14 days from the return of the goods, by transfer of the amount charged to the Credit Card or by Bank Transfer. In case of forfeiture of the right of withdrawal, we will return to sender the purchased goods, charging the same shipping costs. 6.1 Effects of Withdrawal Following withdrawal from this contract, "Pompei Luxury" shall refund all payments made by the purchaser, including delivery costs (with the exception of any additional costs arising from the choice of a type of delivery other than the standard one offered by "Pompei Luxury", without undue delay and in any event no later than 14 days from the day on which "Pompei Luxury" is informed by the customer of the decision to exercise the right of withdrawal. Such refunds shall be made using the same payment instrument used by the customer at the time of purchase, unless otherwise agreed. Where the purchaser has chosen, as a method of payment at the time of purchase, cash on delivery, he must indicate, as part of the online withdrawal form, the bank account to which he intends to receive the crediting of the price. Warranty for defects and deformities of the products and additional information 11.1 Purchases made on "Pompei Luxury" are subject to the rules of the Consumer Code on warranty for defects and deformities of products. Therefore, the customer will be granted the rights set forth in Article 130 of the Consumer Code and these rights must be exercised within the terms set forth in Article 132 of the same Consumer Code. 12. Applicable Law 12.1 These GTC and the contracts of sale are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 regulates distance contracts - and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and in light of this must be interpreted. 12.2 For any disputes that may arise in connection with the GTC and/or contracts of purchase and sale, Customers may activate an out-of-court dispute resolution procedure that complies with the requirements of Articles 141 et seq. of the Consumer Code.
